Drug Crimes

Smith, Montgomery & Associates, P.C., comprised of lawyers and highly-trained staff and one of the leading law firms in Southwest Missouri, is a full service law firm with over 65 years of combined experience.

Drug charges are always serious. Every drug charge holds the potential for large fines and jail time. In addition, a drug charge can expose you to some hidden costs as well:

If you are convicted of possession of a controlled substance, your license can be suspended;
A second possession of a controlled substance charge can be a felony;
Your credit may be affected;
You may be fired from your current job;
You may have trouble getting many jobs in the future; and
You may be required to pay for a drug treatment program.

Missouri drug crimes begin at the Misdemeanor level. In Missouri, there are three classes of misdemeanors:

Class CPenalty: up to 15 days in jail
Class BPenalty: up to 180 days (6 months) in jail
Class APenalty: up to 365 days (1 year) in jail

WE DO NOT WANT THIS TO HAPPEN TO YOU!

Many drug crimes in Missouri are felonies. However, with Missouri drug crimes, each Felony charge can have an enhanced penalty range if a person is accused of a drug crime for a second or third time. In Missouri, repeat offenders are referred to in the law as "Prior Drug Offenders" or "Prior and Persistent Drug Offenders."

A conviction for a drug related crime carries penalties ranging from probation, treatment and community service to the potential of decades in prison. Drug convictions can also lead to the denial of benefits such housing and temporary assistance benefits. A drug conviction on your record, even for a misdemeanor, can hamper your ability to obtain employment in many fields.

Our office has successfully handled hundreds of drug crimes, both felony and misdemeanor, in the Missouri state courts. The scope of our practice includes:

  • Drug Possession
  • Drug possession with intent to distribute
  • Drug manufacturing
  • Drug trafficking
  • Drug cultivation
  • Drug distribution
  • Possession of drug precursors
  • Possession of drug paraphernalia

One reason we are so successful is because our Criminal Defense Team is made up of former Deputy Prosecuting Attorneys who understand how the other side operates. We turn police mistakes into victories for our clients. We inspect your case to make sure that the police did their job properly: did the police have jurisdiction over you?; did the police arrest you properly?; did the police read you your rights?; did the police do the search properly if you or your property were searched?; did the police handle the evidence in the proper way?; and did the police give you a phone call?

No lawyer can guarantee the results of a case; however, we do promise that if we cannot find a way to win your case, we will try to MINIMIZE THE DAMAGE TO YOU. For instance, some of the ways we may be able to MINIMIZE THE DAMAGE TO YOU are: (1) getting your charges dismissed; (2) getting your charges reduced to a misdemeanor; (3) keeping you out of jail; (4) keeping your fines low; (5) keeping the charges off of your record; (6) getting you probation instead of prison time; (7) getting you into drug court instead of prison time; and (8) arranging for you to pay any fines out over a period of time rather than all on your court date.
